1. Ownership

FORTIUS FOUNDATION SPAIN (hereinafter “FUNDACIÓN FORTIUS”) is the entity that owns the website published and hosted under the domain www.escuelahispanica.org, made available to users (natural or legal persons, hereinafter “Users”) for the purpose of providing information about its corporate identity, objectives, and activities.

In accordance with the provisions of Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (“LSSICE”), the following general information is hereby provided to the users of www.escuelahispanica.org (hereinafter, the “Website” or the “Site”):

2. Terms of Use

Users are obliged to make proper use of the Website in accordance with the Law and this Legal Notice. The User shall be liable to FUNDACIÓN FORTIUS or to third parties for any damages that may result from non-compliance with this obligation.

The use of the Website for purposes that may harm the assets or interests of FUNDACIÓN FORTIUS, or in any way overload, damage, or render unusable the networks, servers, and other IT equipment (hardware) or IT products and applications (software) of FUNDACIÓN FORTIUS or third parties, is expressly prohibited.

3. Intellectual and Industrial Property Rights

The Website, including its graphic design, as well as its contents — understood by way of example only to include texts, photographs, graphics, images, software, and other materials — are the intellectual property of FUNDACIÓN FORTIUS or of third parties who have licensed them to FUNDACIÓN FORTIUS. No rights of exploitation recognised under current intellectual property law are transferred to Users. In particular, Users must refrain from reproducing, copying, distributing, making available, publicly communicating, transforming, or modifying the contents, except to the extent necessary for navigation of the Website, in cases authorised by law, or when expressly consented to by FUNDACIÓN FORTIUS.

Distinctive signs (trademarks, trade names, etc.) are the property of FUNDACIÓN FORTIUS or have been licensed to it, and access to the Website does not grant Users any rights over such trademarks, trade names, or distinctive signs.

4. Liability Disclaimer

4.1 Regarding Service Availability:

FUNDACIÓN FORTIUS endeavours to keep the Website operational and error-free, but the User agrees to use the Website at their own risk. The Website is provided “as is,” without any express or implied warranty; therefore, except where legally enforceable under applicable law, we do not guarantee its merchantability or fitness for a particular purpose, nor do we guarantee that access to or use of the Website will be uninterrupted or completely error-free.

Furthermore, access to the Website requires third-party services and supplies, including transmission over telecommunications networks, the reliability, quality, security, continuity, and operation of which are not the responsibility of FUNDACIÓN FORTIUS and are beyond its control. FUNDACIÓN FORTIUS shall not be liable for failures or disconnections in telecommunications networks or other third-party services that result in suspension, cancellation, or interruption of access to the Website.

4.2 Regarding the Content and Services Linked Through the Website:

The Website may include links that allow the User to access other web pages and portals (hereinafter, “Linked Sites”). In such cases, FUNDACIÓN FORTIUS acts as an intermediary service provider in accordance with Article 17 of the LSSICE and shall only be responsible for the content and services provided on the Linked Sites to the extent that it has actual knowledge of their illegality and has not deactivated the link with due diligence. If the User considers that a Linked Site contains unlawful or inappropriate content, they may notify FUNDACIÓN FORTIUS in accordance with the procedure and effects established in Clause 5 of this Legal Notice, without such notification implying any obligation to remove the corresponding link.

Under no circumstances shall the existence of Linked Sites be taken to imply any agreements with their operators or owners, nor shall it constitute a recommendation, endorsement, or identification by FUNDACIÓN FORTIUS with the statements, content, or services provided.

4.3 Regarding the Security of the Website:

Connection to the Website is made through open networks, so FUNDACIÓN FORTIUS does not control the security of data communications or the devices connected to the Internet. It is the responsibility of the User to use appropriate tools for the prevention, detection, and removal of harmful software or malware. FUNDACIÓN FORTIUS shall not be liable for any damage to Users’ computer equipment during connection to the Website caused by third-party actions, nor for the lack of security or confidentiality of information transmitted through third-party telecommunications equipment and networks, or as a result of vulnerabilities in the Users’ own software or hardware.

5. Reporting of Unlawful or Inappropriate Activities or Services

If the User or any other third party becomes aware that Linked Sites, content, or any other service provided through the Website are unlawful, harmful, defamatory, violent, or contrary to public morals, or otherwise infringe the rights of third parties, they may contact FUNDACIÓN FORTIUS providing the following information:

Personal details of the notifier: name, address, telephone number, and email address. FUNDACIÓN FORTIUS shall be responsible for processing any personal data voluntarily provided solely for the purpose of handling the request. Users may exercise their rights in accordance with the Privacy Policy. Failure to provide any of this information may result in the request not being addressed, without prejudice to any voluntary investigation that FUNDACIÓN FORTIUS may wish to carry out.
Description of the facts revealing the unlawful or inappropriate nature of the service.
In cases of rights violations, such as intellectual or industrial property rights, or any other rights not readily apparent to FUNDACIÓN FORTIUS, documentation proving the existence of the legal right must be provided. Additionally, the personal details of the rights holder must be supplied if different from the notifier, along with a representation document authorising the notifier to act on their behalf in such cases.
Explicit declaration that the information contained in the notification is accurate. Receipt of the communication by FUNDACIÓN FORTIUS under this clause shall not, in accordance with the LSSICE, be considered as effective knowledge of the activities and/or content indicated by the notifier.

7. Validity and Termination

FUNDACIÓN FORTIUS reserves the right to make modifications to this Legal Notice, publishing any changes in the same manner as this Legal Notice or through any other form of communication to Users or by another appropriate procedure.

Accordingly, the temporal validity of this Legal Notice coincides with its period of publication, until it is wholly or partially amended, at which point the amended Legal Notice shall take effect. Consequently, Users should carefully read this Legal Notice each time they access the Website.

FUNDACIÓN FORTIUS may terminate, suspend, or interrupt access to this Website or any of the services provided through it at any time without prior notice, without Users being entitled to claim any compensation. After such termination, the prohibitions regarding the use of content set out earlier in this Legal Notice shall remain in force.

8. Applicable Law

All matters relating to our Website and this Legal Notice shall be governed exclusively by Spanish law.
